Medical Negligence occurs when a medical professional’s actions cause injury to a patient. These sorts of negligences can involve a surgeon, dentist, doctor, nurse, dentist, or any other form of medical personnel. 

The fault falls on part of them as medical providers are expected to provide their patients with care that is in alignment with how a trained professional would offer services, when under similar circumstances. 

Common Types Of Medical Negligences 

Here is a list of some of the more common types of medical negligences that occur:

  • missed or delayed diagnosis of the patient
  • an incorrect diagnosis of the patient’s symptoms
  • surgical errors
  • unnecessary treatment
  • omission of taking a proper action
  • a substandard form of treatment

Proofs For Establishing Medical Negligence

This is very similar to proving the other types of negligence out there. Medical Negligence can only be established if:

  • the concerned medical staff owed the patient the duty of care
  • there was an active breach/violation of the duty of care
  • the losses can be calculated with certainty
  • the breach that was brought upon an individual led to losses or injuries
